Statement on Anthem Case Before Law Court

Hopes Ruling Favors Consumers:

"Consumers for Affordable Health Care (CAHC) is the state's largest consumer health organization. CAHC filed a "friend-of-the-court" brief (called an Amicus Curiae brief).  It was filed on behalf of consumers who are Anthem individual policyholders.  CAHC opposed Anthem's proposed rate increase and agreed with Superintendent of Insurance Mila Kofman's decision to reduce Anthem's rate hike from an average of almost 19% to a 10.9% rate increase.  Her decision for this one line of insurance denied Anthem's request for a 3% profit margin.  The Superior Court agreed with the Superintendent that Anthem does not have a statutory or constitutional right to be paid a profit year in and year out.  Again, this case applies only to one small part of Anthem's business - the individual market where ratepayers have no group bargaining clout to get lower rates - they're on their own. In a down economy when consumers are already struggling, insurance companies cannot expect to continue to earn record profits and pay CEOs millions of dollars.  The Superintendent exercised the proper discretion to protect consumers from unnecessary rate increases and her decision should be upheld."
